As part of executing an estate strategy that helps avoid probate, real estate should be owned by your revocable living trust. But what difficulties might come up? In this episode, I review why real estate should be in a revocable living trust and then what issues may come up around 1) buying real estate in a trust, 2) selling real estate out of a trust. And 3) refinancing a mortgage on property in a trust.

The Disjointed Will Plan

People often wrongly assume that when they create a Last Will and Testament, that the Will controls where all of their assets go, when all of their assets are distributed, and who is in charge of handling all of their assets. Unfortunately, this is often not true. Duct tape strategies such as joint property with a right of survivorship and beneficiary designations will render your Will worthless when it comes to those assets. Medicaid Whoopsies

When it comes to Medicaid Planning, there are tons of loopholes that can help a family preserve a lot of assets and have a loved one still qualify for nursing home Medicaid. On the other hand, this also means there are a lot of opportunities for people to “go rogue” and make mistakes without discussing things with the Medicaid Planning Team. In this two-part video, I review some of the mistakes big enough to get specific clauses put into our engagement agreements to emphasize the importance of coloring within the lines. While this video is meant for the general public, it also can provide some insight to attorneys and other professionals who want to do Medicaid Planning for their clients.

You know a plan is broken into a thousand-piece puzzle when the pages of the trust were taken out of the binder, put back out of order, and some pages are missing.
